摘要
在社会管理过程中,政府常以"创新"为由,突破宪法与法律约束,不断地扩充自己的权力。因此,社会管理创新需要通过政府与市场分权、强化社会组织自治功能、建设法治政府与健全基本权利法律体系等路径,对有限政府的权力进行规制。
Abstract： In the modern democratic society, limited government is the mode of government under the rule of law. As a result of the impulse of power expansion, the government often cites ＂innovation＂ , and breaks through the bind of the constitution and laws to continually expand its own power in the process of innovation of social management. Therefore, innovation of social management needs to regulate power of limited government by ways of sharing powers between government and market, strengthening the autonomy function of social organization, constructing government under the rule of law, and improving legal system of basic rights.
