摘要
微博在带来信息自由传播的同时,也带来了一些新的法律问题,给网络监管工作带来诸多挑战。本文在分析微博监管的现状、较优策略及监管对象的基础上,以博弈论作为基本分析工具,分别探究运营监管和舆情监管,揭示微博监管的关键。在博弈分析的基础上,提出完善法律规章制度做到"有法可依"、构建完善的监管体系实现全方位监管及完善行政保护机制等三个对策。
While bringing the free flow of information, microblog also brought some new legal issues which added some challenges to net-work monitoring. Based on analyzing microblog＇s regulatory status quo, optimum strategy and regulatory object, the paper explored oper-ational monitoring and supervision of public opinion with the game theory as a basic tool. Based on the game analysis, we proposed three countermeasures which included improving the legal regulations to achieve“legal basis”, building a sound regulatory system to achieve full supervision and improving the administrative protection mechanisms.
