摘要
地方人大对司法机关的监督,具有国家性、抽象性的特点。目前我国地方人大对司法机关的监督存在不知监督、不能监督、不当监督、不善监督的问题。完善我国地方人大对司法机关的监督,应当遵循"避实就虚"原则、"集体监督"原则、"国家性"与"地方性"兼顾的原则。要提高地方人大的监督效果,应当建立和完善问题发现措施、主题甄别措施、方案确定措施、落实检查措施。要全面发挥地方人大的监督作用,要提倡"预防性"
The local people＇s congress plays a great role in supervising the judiciary with features like na- tionality and abstractness. At present, many problems exist in the supervision system, such the ways to su- pervise,the inability to supervise, improper supervision and poor supervision. Therefore, the perfection of the supervision system should be in accordence with the principler of generality and collective supervision, keep balance of the national and local interest, and take measures to find problems, identify subjects, imple- ment proposals,and assure examinatins. We should also maximize the supervison role of the local people＇s congress and advocate the principle of preventability.
