摘要
在全球化和经济一体化的新格局中,区域治理已经成为一种普遍的趋势。德国在区域治理方面经多年发展已经形成较为完善的制度体系,其重要的治理手段为:由地方政府自发建立区域性协调组织协调关系、促进地方合作、实现管理职能。根据组织设立的法律依据,德国区域治理中的组织主要有非正式合作机制、私法组织、公法组织三种类型,具体形式多样。这些组织所具有的执行力来自于德国悠久的地方自治传统以及严谨庞大的法律体系的保障。作为区域经济一体化的法治协调机制之一,我国实践中也出现了区域性组织的模式。在未来区域经济发展过程中,我国可以借鉴德国经验,增强地方政府的自主性和积极性,逐步完善法制保障,进一步发挥区域性组织的优势。
Regional governance has become a general trend of development in the new pattern of globalization and economic integration. Over the years, Germany has developed a relatively complete system of regional governance. One of the important means of governance under such system are regional coordinating organizations, spontaneously established by local govern ments to be responsible for coordinating the relationship between different regions, promoting re gional cooperation, and realizing administrative functions. These organizations can be classified by the legal basis for their establishment into three main typesinformal cooperation mecha nisms, private law organizations, and public law organizationswhile concrete forms of these or ganizations are many and varied. Their executive power originates from a longstanding tradition of local autonomy and a huge and wellorganized legal system. As one of the legal mechanisms for coordinating regional economic integration, regional organizations have also emerged in Chi na. In the future development of regional economy, China should draw on the German experi ence, enhance the autonomy and initiatives oflocal governments, gradually improve the relevant legal safeguards, and bring the advantages of regional organizations into full play.
