摘要
国际体育仲裁实践中出现的8类裁决结果分别是:程序性裁决中的管辖权确认、管辖权否认、案件撤回3类和实体性裁判中的支持仲裁请求、驳回仲裁请求、部分支持仲裁请求、不予采纳、其他结果 5类。通过对这些裁决进行类型化研究,可以发现:CAS仲裁中存在裁决结果超出申诉请求范围、CAS仲裁庭拥有过大自由裁量权等问题。建议将申诉请求类型化并使之与裁决结果相匹配,剔除撤回类案件,新增和解类案件,规制CAS全面审查权。
In CAS arbitration practice, there are eight different types of awards： jurisdiction affirmed, jurisdiction denied, withdrawal in procedure part, applications held up, dismissed, partially held up, inadmissible and other result in substantial part. It can be found that there are some awards that surpass the scope of review in CAS authority. It is necessary to classify the request of appeal, to pick out the type of ＂withdrawal＂ and to add the type of ＂settied＂, to limit the authority of ＂de novo＂ of CAS.
