摘要
高校学生伤害事故频繁发生,我国对学生伤害事故的处理多采用民事手段,域外国家多建立国家赔偿责任。从法学理论上看,高校为公务法人、教师为公务雇员,高校与学生的关系更多地体现了行政管理关系。在此理论基础上,我国应建立高校学生伤害事故国家赔偿制度,主要包括由教师行为引起的国家赔偿责任和高校设施管理不当引起的国家赔偿。
The college students’ injury accidents have occured frequently ,the way to deal with student injury accident commonly used civil method in China , and many foreign countries established state compensation liability. From the legal theory to explore ,the universities are legal person of public affairs ,and university teachers are public employees,and the relationship between students and universities more reflected the administrative relationship. Based on the theory ,China should establish national compensation system of college students’ injury accidents,including the national compensation responsibility caused by teachers’ behavior and by university facilities of improper management.
