摘要
《职业教育法》的修订必须在调整对象、立法目的和价值理念等方面与《教育法》《高等教育法》相衔接、相协调,以避免法律规定的冲突或重复。职业教育法作为教育法的二级部门法,应以职业教育领域的特殊性社会关系为自己的调整对象,立法目的主要在于确定职业教育的基本法律地位以及为实践性教学环节的有效实施提供切实可行的制度保障。《职业教育法》作为行政法的分支,与一般的部门行政法的不同之处在于教育机构(学校)作为行政相对人享有办学自主权。为切实维护教育机构(学校)的办学自主权,在立法模式上,职业教育法宜采取否定性的立法路径。
The revision of the vocational education law must comply with the law of education and the law of higher education in the regulation objects, legislative purpose and value orientation so as to avoid incongruity and repetition. As a secondary law of education, it must regulate the special social relations of the vocational education. Its purpose lies in specifying the basic legal status of vocational education, providing the basic guarantee to practice teaching. As a secondary law of the administrative law, the vocational education law differs from other secondary laws in the institutional of education (the school) enjoys autonomy in running schools. In the legislative model, it should better take the way of negative legislation.
