摘要
随着广西北部湾经济区工业化和城镇化进程的快速推进,现行的征地制度在征地的目的、审批与实施程序、补偿安置标准和争议仲裁机制等方面均不同程度地呈现出不适应经济社会发展和社会和谐稳定的问题,急需在国家法规和政策框架下实施因地制宜的改革。综合考虑典型国家(地区)征地制度特点,广西北部湾经济区征地制度改革应着力于明晰"公共利益"范畴、完善征地补偿机制、创新和拓宽安置渠道、完善和落实社会保障体系、强化就业指导和就业安置等方面。
With the quick advancement of the industrialization and urbanization in the Economic Zone of Beibu Gulf,Guangxi Region,the present system of land expropriation has not been in con-formity with the development of the economic society and the issues of harmonious stability in such aspects as the purposes of land expropriation,examination,approval and implementation procedures, standards of compensation and placement,systems of controversial arbitration.It is urgently necessa-ry to make reform in the light of local conditions under the structures of national laws and policies.By comprehensively considering the characteristics of land expropriation of some typical countries,the re-form of the land expropriation in the Economic Zone of Beibu Gulf,Guangxi Region should focus on clarifying the scope of＆quot;public benefit＆quot;,perfecting the compensation system,innovating and expan-ding placement channels,improving and carrying out social security system,enforcing employment guide and placement,and son on.
