摘要
在民法总则的制定过程中,认真梳理、重新审视《民法通则》所体现和形成的"民族性"法律资源,对构建中国民法话语体系,构建既有"民族性"的历史内涵又有"国际性"的世界关怀的民法文明有重大意义。有必要以现实中国实践之正当性与全球化价值示范的关系框架为依据对现有民族性法律资源进行审视,以决定取舍或改进。
During the drafting process of the civil code in China, finding and rechecking the national characteristic of the general principles of civil law is important. It is a significant work to achieve a civil code with both national characteristics and international leading level. The choice of legal resources should be considered the relation of the law and the given national life.
