摘要
生存权与发展权既是当代农民权益保护的焦点,也是后代农民权益保护的核心。面对农村土地流转集中的趋势及其不同的表现形式,需要以生存权与发展权为中心来思考土地流转"集中度"与代际公平的关系问题。代际公平视域下,农村土地流转过度集中会产生损害后代农民土地上的生存权与发展权以及农业产业的可持续发展等风险。合理把握土地流转"集中度",维护土地权益分配的代际公平,可以从"法律保障→权益代表→权益实现"的逻辑来思考,并建立起代际法律保障机制、代际权益代表机制以及后代人权益实现机制。
Subsistence and development rights are not only the focus of contemporary farmer rights and interests protection, but also the core of descendant rights and interests protection. Owing to the concentration tendency of rural land transfer and its different manifestations, it is necessary to reflect on the relationship between the concentration of land transfer and intergenera- tional equity based on subsistence and development rights. From the perspective of intergenera- tional equity, the excessive concentration of rural land transfer may damage subsistence and de- velopment rights of the descendants of farmers on the land and the sustainable development of ag- ricultural industry. The rational grasp of the concentration of land transfer and the maintenance of in- tergenera-tional equity of the allocation of land rights and interests can be based on the logic of le- gal protection, rights representative and rights realization, and the establishment of intergenera- tionat legal protection mechanism, intergenerational equity representative mechanism and realiza- tion mechanism of descendants＇ rights and interests.
