摘要
国际体育组织对国际体育法的发展以及国际体育运动实践都起到了重要的推动作用,但国际体育组织相关法理依据的欠缺限制了其功能的进一步发挥。以法律多元格局为视角,运用传统国际法理论与"全球体育自治法"理论,为国际体育组织的存在和运作寻求法理依据。国际体育法概念的演变体现了国际体育组织在国际体育法秩序中的作用,并逐渐形成了独特的"全球体育自治法"理论;从国际法传统理论视角分析国际体育组织的法律人格,政府间国际体育组织具有国际法主体资格,非政府间国际体育组织不具备国际法主体资格,仅为设立国的国内法人,而在"全球体育自治法"理论下,非政府间国际体育组织具有"全球法"上的主体资格;根据传统的国际法渊源理论,国际体育组织"内部法律"属性是"国际软法",而依据"全球体育自治法"理论,则属于独立的"全球法",但"国际软法"概念下的国际法渊源理论更为成熟。
International sports organization plays an important promoting role in international sports law and international sports practice. However, the deficiency in relevant legal basis lim- its the further function it＇s creative to explore the legal basis of international sports organiza- tion by applying the traditional international law theory and the ＂autonomous global sports law theory＂. The evolution about terms and concepts of international sports law reflected the inter- national sports organization＇s function on international sports law order, and as a result, a dis- tinguishing theory--the ＂autonomous global sports law theory＂ established. Analyzing the ju- ridical personality according to the traditional international law theory, intergovernmental sports organization has the qualification of subject of international law; the non- intergovernmental sports organization has not the qualification of subject of international law, which only belongs to the domestic legal person. However, according to the ＂autonomous global sports law theo- ry＂, international sports organization has the qualification of subject of ＂global law＂. On the basis of the traditional international law theory, the attribute of international sports organiza- tion＇s ＂internal law＂ belongs to ＂international soft law＂, but belongs to independent ＂global law＂ in accordance with he ＂autonomous global sports law theory＂, the ＂sources theory of international law＂, which leads into the concept of ＂international soft law＂, appears to be more mature and comprehensive.
