摘要
李琛教授的《著作权基本理论批判》,系对著作权基本原理的反思之作。本文通过对作品中有关著作权的正当性及功能和著作权性质的批判两个问题展开自我理解式的述评与解读,并试图提供某种自我解释的观照,以回应原作的部分观点。反思是一种尝试,即试图为制度之理论提供某些传统之外的另类见解与立场,以丰富著作权观念的市场。
The Critique of the basic theory of＇copyright, written by professor Li Chen, is a book which rethinks the basic theory of copyright. After reading the book, the writer want to analyze two questions in this book to express his own opinions, they are ＂the legitimacy and function of copyright＂ and ＂the nature of copyright＂. Rethink is a kind of attempt to provide more alternative academic views other than traditional theories to enrich the copyright theory market.
