摘要
海洋综合开发中大批渔业捕捞海域被开发、变更,导致职业渔民"捕捞用海权"等权益和利益受损。通过阐述舟山海洋综合开发建设过程中职业渔民权益保障现状,在对现行《渔业法》对渔民捕捞权益规定进行分析的基础上,提出了完善相关法律法规体系,建立海洋综合开发与渔业捕养海域(滩涂)变更救济保障基金及实施办法、职业渔民相关权益和经济利益补偿机制及海洋综合开发建设信息公示和听证制度等意见和建议。
Much of fishery waters has been developed and changed in the marine integrated development, which leading to the damage of the occupational fishermen＇s fishery and so on. Firstly, the article analyzes the damage of the occupational fishermen＇s rights in the marine integrated development, and the provision of fishermen＇s rights in the ＂Fishing Law＂. Then, the author proposes some suggestions such as the improvement of relative laws and regulations, the establishment of the security and relief funds in the marine integrated development and the fishery waters （tidal） change, the protection of fishermen＇s rights and the economic compensation system, and the establishment of information opening and hearing system in the marine integrated development.
