摘要
宪法序言是一国宪法的有机组成部分,具有同宪法正文同等的最高法律效力。且这种法律效力既体现在其具有制约宪法正文各条款解释的功能方面,也体现其在一定条件下可作为宪法审查机构进行合宪性审查的依据方面,尽管宪法序言并不是赋予公民基本权利或授予国家机关职权的准据。
Preamble to the constitution is the organic part of constitution, with the same supreme legal validity as the constitution text. Although preamble to the constitution isn＇t grounds for giving citizens fundamental rights or empowering the state organs, its legal validity is reflected by restricting the interpretation of the provisions in the constitution text, and Under certain conditions, it may be applied by the constitutional supervision agencies as the basis of constitutionahty review.
