摘要
依据行政法,行政机关可以为了公共利益对个人利益进行限制,但行政权力的扩张本性,使公共利益与个人利益矛盾重重,公共利益在限制个人利益方面存在诸多困境,由此引发的社会矛盾和问题日益增多。和谐社会需要各种利益的平衡,协调好二者的关系是和谐行政的关键,为公共利益限制个人利益设定合理边界必不可少。影响"公共利益"限制个人利益边界的五个要素(渊源、主体、客体、内容和效力)的确定,使"公共利益"限制个人利益的合理边界在理论上具有了可行性;公正补偿原则为"公共利益"限制个人利益的合理边界增加了实践上的合理性和可操作性。
On the Administrative Law,the administrative organ may limit the personal interest for the public interest.But by the expansionism of administrative power,there exist many difficulties in limiting the personal interest and social contradictions and problems it caused are increasing.Harmonious society needs to balance all kinds of interests and coordinate the relationship of them.So it is necessary to set the rational boundary of public interest to limit personal interests because personal interests are the foundation of public interest.The 5 elements of the public interests to limit personal interests:original, subject,object,content and application effect and the principle of Just compensation should be the rational boundary in order to ensure the administrative behavior not only to be legal but also to be reasonable and appropriate.
