摘要
大型体育赛事在运行过程中会受到民商事法律风险的影响,通常需要对民商事法律风险进行有效控制,才能保证大型体育赛事产生积极的社会效益和经济效益,确保体育赛事能够正常运转。当前需要从体育赛事民商事法律风险管理模式、风险评估、风险控制策略等角度实施合理的方案,保证把大型体育赛事的民商事法律风险控制到最小状态。风险计划实施过程中由于存在民商事关系主体和客体不同性质的问题,需要从民商法中财产关系、人身关系、物权关系、债权关系、所有权关系出发,建立完善的风险计划体系,提升大型体育赛事风险防控能力。
Major sports events will be affected by the civil and commercial legal risk, so it is often necessary to control the risks in order to ensure the social and economic benefits as well as the smooth operation of such events. Rea- sonable plans concerning civil and commercial risk management, risk assessment and risk control have to be implemen- ted to minimize the civil and commercial legal risks of major sports events. Problems of different natures between subject and object exit in the implementation of risk plan. Therefore, perfect risk plan system has to be established from the as- pects of property relation, personal relation, real right relation, contractual relationship and ownership relationship.
