摘要
修订后的国家赔偿法中增加了精神损害抚慰金制度,体现了国家对公民合法权利的重视程度。但对精神损害严重程度的认定及抚慰金数额标准等操作细节未做具体规定,导致了实践执行的困难。因此,我们应借鉴国外相关制度的可取之处,结合本国实际,对精神损害严重程度的认定和精神抚慰金的数额标准加以规定。
The revised State Compensation Law has increased mental damage solarium system and reflects the degree of national attention towards the citizens＇ legal rights. However, the lack of specific provisions on such operating de- tails as the determination of the severity of mental damage and the standard of solarium amount has caused the prac- tical difficulties of execution. Therefore, we should learn from foreign related system＇ s merits, combine them with the actual situation in China, and stipulate the determination of the severity of mental damage and the standard of mental solatium amount.
