摘要
笔者在考察首要分子与主犯的关系所赖以建立的基础之上 ,认为集团犯罪的首要分子并非都是主犯 ,而聚众犯罪的首要分子则一定不是主犯。
The author considers that the chief culprit of the group crime is not always the principal,and the chief culprit of the mob crime is nothing but the principal,seeing about the base of the relationship between the chief culprit and the Principal.
