摘要
伴随我国知识产权事业的发展,专利代理服务体系建设从无到有,从小到大,日益完善,取得了显著成效。但是,在行政监管与行业自律方面,专利代理行业仍存在一些问题和不足,如行政监管机制不够健全,行业自律功能有待完善等。这些问题制约行业健康发展,亟需解决。细致梳理代理行业在行政监管与行业自律方面的10个主要问题,从法规制度建设、顶层设计等多个方面剖析了原因,针对性地提出建议。
With the cleveiopment of China＇s lnteil＇ectual property career, patent agency service system is becoming increasingly sophisticated and has made many outstanding achievements. However, in the aspects of administrative supervision and industry self-discipline, there are still some problems and deficiency in the patent agency industry, such as administrative supervision mechanism is not perfect, and industry self-discipline function remains to be improved. As these problems have restricted the healthy development of the industry, they should be solved as soon as possible. 10 important issues in this sort of administrative supervision and industry self-discipline are discussed, and then this paper try to analyze the deeper reasons of those issues from the aspects of regulations construction and the top-level design. Finally, this paper puts forward some specific and constructive proposals.
