摘要
自白补强规则是一项证明力规则,是对自由心证制度的限制,是用其他证据对自白之证明力予以补强的证据规则。而在共同犯罪中,如何对共犯自白进行补强就更加复杂且困难了。因此必须坚持两项原则,一是仅有共犯自白时不能定罪,二是共犯自白不能相互补强。如果能妥当处理好这两个方面,那么共犯自白补强问题势必能得到较好的解决。
The ride of Confessions Reinforcement is a rule probative force, is a restriction of free proof system is the use of other evidence of probative force on the confession to be reinforced rules of evidence. And in the crime, how to be an accomplice confession is even more complex and difficult to reinforce it. Therefore, we must adhere to two principles, one can not be convicted only accomplice confession, the second is an accomplice confession can not be mutually reinforcing. If you can properly handle these two aspects, then the problem is bound to an accomplice from the rule of Confessions Reinforcement be a better solution.
