科斯的产权不仅存在于私法,还存在于公法当中;不仅仅指人权,还包括物权;有些地方究竟指什么,恐怕连他自己都很难说清楚。后人更是越解析越离谱。其实,产权就是财产所有权的简称,产权与财产所有权的区别是不存在的,存在的只是对财产所有权的误读。财产的所有权较之财产的权利更能够说明各项财产权利的功能和逻辑关系。
