摘要
近因原则是我国保险法理论的基本原则之一。在我国,尽管《保险法》等相关法律法规尚未对近因原则做出明确的规定。但是,在法院和仲裁机构对保险纠纷案件处理中,近因原则已成为判断保险人是否承担赔偿责任的重要依据。本文试以阐述近因原则之内涵,结合具体案例,详细论述其在实践中的运用规则,从而为完善我国保险立法提出一定建议。
The principle of proximate cause is one of the basic principles of insurance law in our country. In our country, although the Insurance Law and other relevant laws and regulations have not make clear rules to the principle of proximate cause. However, in the court and the arbitration agency, the principle of proximate cause is the important basis to judge whether the insurer shall bear the liability for compensation. The paper tries to expound the connotation of the principle of proximate cause, combined with the specific case, discusses on its use in practice, so as to put forward certain suggestions for perfecting our country＇s insurance legislation.
