摘要
民事判决书的判决理由部分起着树立司法权威和公信力的作用,故而有必要对判决理由的评价策略进行分析探讨。本研究选取民事判决书10份作为语料,借助评价理论中的介入系统对其中的判决理由部分进行标注和统计,从否认、反驳、接纳、背书和同意五个子项目对来分析讨论其评价策略使用的动因。此项研究意义在于了解民事判决书评价策略现状规律和探讨如何通过人际意义的调节以确保判决书的法律评判功能和社会指引功能的实现。
The cause of judgment is the indispensable part of a civil judgment, which illustrates the authority of judicial system. Therefore to probe into the judgment strategies means much. 10 civil judgments are selected and tagged as corpus, this study probes into the reasons of using the following strategies deny, counter, entertain, endorse and acknowledge, which also helps to pattern the usages of these strategies and to understand the ways to achieve judicial goals.
