摘要
在调查、总结建设工程施工合同履行过程中各类合同争议表现形式的基础上,对建设工程施工中发生几率高的合同争议进行归纳分析,按照建设工程合同签订、履行至终止的过程,探究争议形成原因与作用过程。研究发现,解决争议重点在于三个环节与三个合同管理过程,并根据管理系统思想,提出基于成因分析的争议管理对策。
Based on the survey of disputes during the execution of construction contract, this paper sums up the highly probable disputes, and explores the causes and mechanism of the construction contract disputes according to signing, execution and termination of construction contract. This paper concludes that three links and three manage- ment processes are critical, then puts forward the countermeasures of construction contract dispute based on system theory
