摘要
按揭是我国日常经济活动中较为常见的一种购房贷款行为,它通过房地产商等原有房产所有人作保,将购房者需要购买的房产产权作为按揭银行的按揭资产来获取贷款以偿还房产需要支付的金额。这种将房产所有权作为按揭资产来获取贷款的形式,虽然没有在房产部门将房产过户给银行,却通过按揭合同约定了银行在相应条件下对房产所有权的拥有。购房者申请提前还贷时,要慎重考虑还款的分期和还款是银行利率浮动趋势,从而使提前还贷计划能够帮助购房者降低放贷成本,我国民法对房地产按揭进行了具有中国特色的解释,并有配套的民法规条对房地产按揭活动的相关活动进行约束,然而在房地产按揭行为实践中依然要谨慎对待。
Mortgage is a mortgage behavior common in daily economic activity in China,the real estate business,the original property owners for property buyers,the purchase of real estate property rights need as mortgage bank mortgage assets to obtain loans to repay housing need to pay the amount.This property ownership as mortgage assets to obtain the form of loans,although not in the real estate sector will be the transfer of property to the bank,but the bank mortgage contract of property ownership in the appropriate conditions.Applications for the purchase of advance owing on the loan,to consider carefully the repayment of the staging and repayment is the bank interest rate floating trend,so as to advance owing on the loan program to help buyers to reduce the cost of lending,China’ s civil law with Chinese characteristics,the interpretation of the real estate mortgage,and activities related to civil law rules related to the real estate mortgage activities are carried out constraint,however in the practice of real estate mortgage behavior still should be treated with caution.This paper will discuss issues related to China’s mortgage of civil law regulation.
