摘要
国家的重要职能是对社会进行管理,国家的各类权力机关都是社会管理创新的主体。人民法院作为专司司法审判权的国家机关,同样是国家对社会进行管理的重要机关之一,也应当在工作中进行创新。尽管人民法院需要进行社会管理创新,但是其只是社会管理创新的一个方面,不是全部。人民法院在社会管理创新中的作用是有限的,因为审判程序有其固有的特点和规律。人民法院是社会管理创新的最终保障,通过确认权力和权利来保障国家机关的社会管理创新不偏离法律的轨道。
Social management is an important function for a country, and all kinds of state organs is main body of social management innovation. The People＇s Court, as a judicial organ, is one of important and main so-cial management organs, which also needs innovation in judicial work. Although the People＇s Court needs social management innovation, it is only one aspect of social management innovation. Its role is limited in social man- agement innovation, because judicial procedure has inherent characteristics and rules. The People＇s Court, the ultimate guarantee of social management innovation for all state organs, confirm the power and right to guarantee social management innovation of all state organs keep within the orbit of law.
