摘要
我国的社区矫正制度已经正式实施,相应的《社区矫正实施办法》也已经颁布。但是由于实施社区矫正场所的不确定,出现了直接在社区进行矫正与"中途之家"进行间接矫正两种模式,各省市之间矫正的模式有较大的差异。基于审前调查制度的缺陷、矫正模式与刑罚个别化的裂痕等因素,在实践中需要两种模式并用,通过对不同犯罪性质的划分以及对被矫治者的具体分析来决定采用何种模式,此外还要结合社会组织的与公众的参与才能真正实现被矫治者重新融入社会,实现预期效应。
China＇s community correction system has been formally implemented, meanwhile the Implementation of Community Correction Measures has also been promulgated. However, due to the uncertainty of the implementation locations of community corrections, there are two modes ： corrected directly in the community and corrected indirectly in the ＂Halfway House＂. Modes of corrections among provinces and cities have large differences. These two modes should be retained. Through division of the differ- ent nature of the crime and specific analysis on those who are corrected, we can decide which mode to apply. In addition, only with the participation of social organization and public can those who have been corrected really re - integrated into the communi-ty, so as to achieve the desired effect.
