摘要
首先从诉讼管辖基础理论之角度对民事诉讼管辖和海事诉讼管辖的划分标准进行了评述,认为远期运费协议纠纷由海事法院管辖具备理论上的合理性;其次从比较法之角度考察了英国、澳大利亚和美国法中对远期运费协议纠纷是否属于海事请求的认识,提出明确中国海事法院对远期运费协议等航运金融衍生品纠纷的管辖权具有现实必要性。
This paper reviews the classification standard for civil jurisdiction and maritime jurisdiction and then comes to the conclusion that it is theoretically reasonable for maritime courts to have jurisdiction over forward freight agreements, Further, this paper compares the cases over the nature of forward freight agreements in the U. K, Australia and the United States and concludes that it is of great necessity in practice to give the Chinese maritime court the jurisdiction over forward freight agree- ments.
