摘要
方便登记之盛行已致真正联系标准虚拟化。授籍条件之取舍应顺应国际海运自由化,兼顾海运发展和水上安全。为免滥用开放登记,须强化港口国监督,确立港口国监督的核心地位,以一般性国际规则和标准为依据,以外部监督促进开放登记的有序运作,抵制低标准船舶进入国际海运市场,确保授籍条件符合水上安全之需。
Abstract ：The prevailing convenient registration has resulted in the virtualization of the standards for genuine link. The choice of ship register conditions should be adapted to the freedom of international shipping, taking account of the shipping development and the waterborne safety. To prevent the abuse of open register, the port state control should be strengthened and the central role of the port state control should be established among the various state controls. The port state control should be based on the generally recognized international rules and standards. By such external control from the port states, the open register could be expected to operate as required, rejecting the sub-standard ships accessing to international shipping market and ensuring the register conditions being maintained in compliance with the waterborne safety.
