摘要
本世纪以来,随着刑罚轻缓化、个别化和行刑社会化理论的不断成熟并获得推崇,学术界对假释制度的研究兴趣日渐浓厚,研究成果无论在数量上还是质量上都取得了较大的突破。现仅就本世纪学者对假释的性质与决定权、假释的适用、假释的监督考察、假释的撤销等重点问题的研究做一简要评述。
Since the beginning of this century, with the mitigation of criminal penalty, and with criminal individualization and socialization of penalty execution growing more sophisticated and wining praise, the academic circle has increasing interest in parole system, making qualitative breakthrough in research both quantitatively and qualitatively. This article gives a brief review of the study on some key issues such as the nature and the decision power of parole, the application of parole, the supervision and inspection of parole, and the revocation of parole etc.
