摘要
TRIPS协议明确将商业秘密纳入到知识产权保护体系从而使商业秘密的知识产权属性得到较广泛的认可。商业秘密作为一种新型的知识产权是对专利、商标等传统工业产权保护不足的有益补充。目前国际上主要通过签订国际条约、反不正当竞争法以及专门立法对商业秘密提供不同层次和不同形式的保护。生产力水平和技术水平的差异使得协调发展中国家与发达国家在商业秘密保护方面的利益冲突变得必要。我国应通过立法进一步加强与国际间商业秘密保护规则的协调,促进商业秘密法律保护的进程。
TRIPS have made it clear that trade secrets are in the scope of intellectual property protec- tion in order that the property right of knowledge is widely recognized. This makes up for the lack of protection of traditional industrial property such as patents and trademarks. Presently, the interna- tional community achieves different levels and different forms of protection by signing international treaties, anti-unfair competition law, and special legislation on trade secrets. The differences in pro- ductivity and technology make it necessary to reconcile the interest conflicts between developing and developed countries in protecting trade secrets. China should further strengthen its coordination with the international rules of trade secret protection through legislation.
