摘要
近年来,职务犯罪案件普遍存在着轻刑化的现象,突出表现在非监禁刑比例偏高、财产刑适用数量少、法律监督比较困难等方面,其原因主要是法律规定存在缺陷、审判机关量刑存在失范、检察机关办案存在偏差,而解决这一问题需要从完善法律规定、规范量刑行为、强化检察职能三个方面入手。
In recent years, light punishment of duty crimes is common, which is mainly manifested in high proportion of non - imprisonmem penalty, little application of property penalty and difficulty in legal supervision, etc. The reasons for it are that laws are to be perfected, judicial institutions are not normal in measurement of penalty and procuratorates＇investigation deviates from normal practice. The solution to the problems it is to perfect the legal stipulations, normalize the sentencing and strengthen the duty of procuratorates.
