摘要
转型期食品安全问题频发,暴露出中国市场经济体制的不完善性以及社会性规制失灵。从规制经济学的角度考察,食品安全问题的出现主要源于三方面原因:一是信息的不完备性导致市场治理机制失灵;二是规制成本大大超过规制收益,严重降低了政府的规制效率;三是企业、监管机构以及各级政府之间复杂的利益博弈,削弱了对食品安全规制的激励机制。杜绝食品安全问题,强化社会性规制需要从三方面采取有效措施:一是通过完善制度建设唤醒市场的自发秩序治理能力;二是推进社会性规制体系改革,提高政府规制的有效性;三是引入公民社会的参与,弥补食品安全规制领域的市场失灵与政府失灵。
The frequent occurance of food safety problems in the transition period exposed the imperfect of China＇s market economic system and social regulation failure. From the perspective of regulation economics, food safety problems mainly comes from three aspects reasons： the first one is the information incomplete caused the failure of market governance mechanism, the second one is regulation cost is considerable more than the regulation income, which seriously reduced the efficiency of gov- ernment regulation, the third one is the complicated benefit game among businesses, regulators and governments at all levels weakens the incentive mechanism for food safety regulation. Putting an end to food safety problems and strengthening the so- cial regulation need to take effective measures from three aspects： one is awaken the spontaneous order management ability of the market through perfecting the system construction; two is to promote the reform of social regulation system, improve the effectiveness of government＇s rules and regulations; three is to introduce the participation of civil society ang make up for the market failure and government failure in the field of food safety regulation.
