摘要
《关于修改〈中华人民共和国刑事诉讼法〉的决定》,将未成年人刑事诉讼理念立法化,符合"教育、感化、挽救"的刑事司法政策,有助于增加社会矫正效果,增强未成年人的法律意识,节约司法资源。但关于新刑诉法中未成年人案件特别程序的适用,仍须转变理念,不断调整并发现问题,才能对司法的改革创新有积极作用。
On the Revision of the Criminal Procedure Law of the People＇s Republic of China makes the legislation of juven- ile criminal prosecution idea. The decision is in accordance with the criminal justice policy of ＂ education, probation, save＂, and can increase the social correction effect, enhance the juveniles＇legal consciousness, and save judicial re- sources. But for the application of special procedures in the case of juveniles, we should duly discover the problems and change the ideas and make positive effect on the justice reform.
