摘要
本文探讨了大陆系主要国家民法典的理论渊源。作者认为 ,德国民法典创立的潘得克吞体的总则部分掩盖了“人法”的价值。作者提出的我国民法典基本结构包括人身关系法和财产关系法两大部分。在此基础上 。
After approaching to the theoretic recourses of civil codes in the Civil Law Countries,the author believed the German Civil Code(BGB)had ignored the value of “Personal law”because of the General Provisions.The author suggested that the draft of China's civil code should include two parts,the law of personal relations and the law of property relations.The author in this paper designed the framework of some important systems of the draft of the civil code.
