摘要
因移动式钻井平台法律地位不明确,沿岸国和钻井平台登记国可分别依据对专属经济区资源开采的管辖权和属地管辖权对其进行管理。分裂的管辖权阻碍了沿岸国对移动式钻井平台的有效监管,一旦移动式钻井平台发生油气泄漏,将使沿岸国处于极其不利的地位。移动式钻井平台是为探测大陆架及开发其天然资源而建立的,这一规定与设施的目的相符;且将移动式钻井平台视为设施可保障沿岸国对其专属经济区的绝对管辖,进而制定统一要求,降低污染风险。对中国而言,将移动式钻井平台视为设施后,可以依据1982年《联合国海洋法公约》和国内立法对设施的专门规定对移动式钻井平台在专属经济区的开采活动进行排他性管理,维护自身利益。
Owing to the ambiguity of the legal status of the mobile drilling platform, the state of registration as well as the coastal state is entitled to manage its operation, relying on the jurisdiction of exploiting resources in the exclusive economic zone and territorial juris- diction respectively. Therefore, the split jurisdiction leads to ineffective supervision of the operation of mobile drilling platform by the coastal state. What is worse, it will enable the coastal state in an extremely unfavorable position if accidental spills occur when the mobile oil platform operates. The aim to construct mobile drilling platform is to explore and the exploit natural resources on the continental shelf, which is consistent with that of an installation. Further and even more importantly, it is beneficial to the exclusive ju- risdiction in the exclusive economic zone of the coastal state and drawing up uniform requirements to reduce the risk of pollution, if regards the mobile drilling platforms as installation. As far as China is concerned, it is entitled to manage the operation of mobile drilling platform exclusively and safeguard their own interests relying on the 1982 United Nations Convention on the Law of the Sea and the specific provisions of domestic legislation when considering the mobile drilling platform as installation.
