摘要
法制现代化是一个开放的国际性的法律发展过程 ,中国在法制现代化的过程中应移植发达国家的法律。法律移植不是对外国法的全文照抄。我们应该将外国法与本土的习惯法有机整合 ,来实现移植法的本土化 。
Modernization of legal system is exoteric and international developing process of law.China ought to transplant developed country's law in this process.Law transplantation does not mean to copy the foreign law word for word.We should conformity the foreign law and the unwritten law of mainland.Do it,we can achieve nationalization of the transplanted law,and create the legal system of modernization of China's characteristic.
