摘要
"背篼"作为生活在贵州城市中的一个特殊劳动群体,在出卖劳动力的过程中,他们的人格尊严经常被践踏。本文就目前我国学者对"背篼"研究多侧重于"背篼"的生存状况,而忽略了他们的人格尊严保护这一现象进行反思,在辨析"生存"与"生活"概念的基础上,追寻维护"背篼"尊严的法律依据,结合"背篼"人格尊严遭践踏的现状来论证维护"背篼"尊严的重要性和必要性,并提出利用传媒宣传人格尊严平等、对"背篼"进行登记造册、组建"背篼"帮扶志愿者团体、建立"背篼"听证制度等保护"背篼"人格尊严的建议和措施。
Being a special labor groups living in the cities of Guizhou, the personal dignity of ＂Basket Carriers＂ is often trampled upon in the process of selling their labor. Scholars focus on the living conditions of the ＂Basket Cam- ers＂ while ignoring the reflection of their personal dignity protection. This paper, based on analysis of the concept of survival＂ and ＂living＂, pursues the legal basis for maintaining the personal dignity of the ＂Basket Carriers＂, by corn- bining with status that personal dignity being seriously trampled, justifies the importance and necessity to protect per- sonal dignity ,of ＂Basket Carriers＂, and proposes protection suggestions and measures like popularizing equal person- al dignity by media, ＂Basket Carriers＂ registration, formation of volunteer groups for helping ＂Basket Carriers＂, set- ting up hearing system for ＂basket Carriers＂, and so on
