摘要
本文在对制度、土地制度、产权及土地产权等概念加以界定的基础上,探讨了土地制度与土地产权之间的关系,指出:人们在相互交往中形成一定的与土地有关的关系,在一定的土地关系中产生对土地的产权要求,在条件合适的时候这种产权要求制度化后就形成土地制度。
On the basis of defining institutions, land institutions, property rights and land property rights, the paper argues that land property rights are required when relation between people and land emerges in their social interaction. Land institutions that regulates the land property rights and its effects on peoples behaviour to land will be formulated after the demand for the land property rights is institutionalized in the suitable condition.
