摘要
英国对南极"伊丽莎白女王领地"主张主权,其合法性存在争议。依据先占的规则,参照人类在南极及其附近地区的实际控制能力,英国没有实际控制"伊丽莎白女王领地",不能基于先占取得在该地区的主权。由于《南极条约》的效力,目前英国"伊丽莎白女王领地"的主权主张不能影响此地区的主权归属,其主权归属仍处于未定的状态;"伊丽莎白女王领地"主张的提出也违反了《南极条约》的宗旨,英国不享有对"伊丽莎白女王领地"所在地区的主权。
Britain's claim of the sovereignty over the'Queen Elizabeth Land'in Antarctica has caused controversy.Taking the capacity of effective control of human beings in the Antarctica and its adjacent areas into consideration,according to the rule of occupation,Great Britain has not maintained effective control over the area of the 'Queen Elizabeth Land'and thus cannot acquire the sovereignty over such area on the basis of occupation.In the context of the Antarctic Treaty,the current claim of sovereignty over the area of'Queen Elizabeth Land' cannot have any effect on the sovereignty over such area.The sovereignty of this area remains unclear.Furthermore,the claim of sovereignty in this area is inconsistent with the objective of the Antarctic Treaty.Therefore,Great Britain cannot acquire the sovereignty over the'Queen Elizabeth Land'.
