摘要
高校运动伤害事故频发,引发了许多校方与伤害方的司法纠纷。通过研究大学生伤害事故所涉及的相关法规,明确运动伤害事故应依据过错责任原则。在对高校体育运动伤害事故案例进行实证分析的基础上提出,应设立《学校学生意外伤害理赔与处置法》,明确当事双方的权利和义务;大力推进学生意外伤害保险制度,最大限度使受伤害方得到合理补偿;加强学生安全教育,减少大学生运动伤害事故的发生。
Frequent sports injury accidents in universities have arisen a lot of legal disputes between the university and the party injured. Laws and regulations related to the sports injury acci-dents of college students have clarified that the principle of liability with fault should be adopted to determine the subject with the faults. Based on the empirical analysis of the sports injury cases in universities, it is imperative to establish a complete law about sports injury compensation and manage- ment in universities. By explicating the rights and obligations of both parties in the accident, the insurance system of accidental injuries for students, in which the legitimate interests of the party in-jured are maximally compensated, should be promoted. The universities should also reinforce safety education to the students in order to minimize sports injury accidents.
