摘要
司法鉴定性质、侦查机关鉴定机构和鉴定人管理、司法鉴定监督等问题一直以来都是人们热议的焦点,尤其在地方立法中表现出的缺失更值得关注。以剖析地方立法为切入点,认为司法鉴定是诉讼中解决专门问题的一项活动,侦查机关的鉴定机构和鉴定人必须实行统一管理,应加强对司法鉴定活动的多层次、多角度监督,该监督包括国家权力机关的监督、社会的监督和党的监督等等。
The property of judicial expertise, management of expert witness and judicial organs in criminal investiga- tion departments of China, supervision of judicial expertise has long been the focus of people, and the absence of local legislation is especially worth more attention. This paper first analyzes the local legislation of China. Then it deems that judicial expertise is an activity to solve special problems in litigation, management of expert witness and judicial organs in criminal investigation departments should be unified. It is necessary to exercise a multi - level and multi - angle supervision on judicial expertise, and this supervision should include state authority surveillance, social supervision, and CCP supervision, etc.
