摘要
新刑事诉讼法将"技术侦查"作为独立一节规定,肯定了其证据地位的同时也对侦查机关的使用提出了具体的要求,这必将对侦查主体的实践产生重大影响。当前新刑诉已经正式生效,侦查机关使用技侦措施在案件范围、申请程序、操作过程等方面受到全面的规范和制约,详悉新《刑事诉讼法》对公安机关使用技侦措施的影响是当前公安机关理论与实践应当关注的重点问题。
＂Technical detection＂ is stipulated in an independent section of the new Criminal Procedure Law,which affirmed its role as evidence and put forward specific requirements for the use of detection organs.This will certainly have a great influence on the practice of detection subject.As the revised Criminal Procedure Law has formally went into effect,the use of the technical detection measures has been standardized and restricted in the scope of cases,application procedure,and operation process,etc..It should be the key point in the theory and practice of public security organs to clearly know the effects of the new Criminal Procedure Law on the use of technical detection measures.
