摘要
检察制度是司法系统一项重要的法律制度。分析我国的检察制度,首先要关注的是检察权的问题;检察权是一项独立的国家权力,法律监督是其根本属性。我国现行检察制度主要存在四个方面的问题,影响其法律监督权的充分发挥。推进我国检察制度改革,应从检察队伍建设、检察机构体制、法律监督层级关系和内外监督体系等方面着手。
Procuratorial system is an important legal mechanism in judicial system. Procuratorial power receives the most concern in China＇s procuratorial system. Procuratorial power is an independent state power with legal supervision as its fundamen- tal attribute. In current China, there remain some problems affecting the full display of legal supervision. To advance the procura- torial system reform in China, efforts should be made in the construction of procuratorial staff, procuratorial mechanism, legal su- pervision levels and the internal and external supervision system.
