摘要
随着我国《农民专业合作社法》的颁布实施,农民专业合作社作为新兴市场主体正在快速发展。法律上如何界定它的性质,学者们观点不一。本文认为,我国的农民专业合作社在法律上是私法人、营利法人。
With the promulgation and implementation of Farmer Professional Cooperative of the People＇s Republic of China, the farmer professional cooperative, whieh as the emerging market subject, is developing rapidly. On how to de- fine the nature of the eooperative, seholars have different views. In this paper, it is held that the farmer professional co- operative of China is the private legal person and for-profit legal person in law.
