摘要
本文以某基层法院近五年来办理公证债权文书执行案件的情况为样本进行分析,指出公证债权文书强制执行制度存在的问题及在执行实践中的一些难题,并提出应在公正理念下对公证债权文书强制执行制度加以完善的相关建议,以期形成执行法官和公证员对公证债权文书强制执行制度的统一认识,实现公证债权文书执行制度的公正价值。
This paper takes it as an example for analysis that a Grass-roots Court has handled some Notarial Creditor＇s Rights Writ Enforcement Cases for five years, and points out some problems of Enforcement of Notarial Obligatory Right Document System in practice, and puts forward some perfection measures that Enforcement of Notarial Obligatory Right Document System should be in Impartiality in order to form implementation of unified understanding of Notarial Creditor＇s Rights Writ Enforcement System by judges and notaries and finally realize its fair value.
