摘要
山东半岛蓝色经济区在建设中会伴生一系列生态环境隐患,如由现代海洋产业体系的构建以及海洋工程建设、滨海旅游等引发的海域污染、海洋生态系统破坏和海洋资源枯竭问题等。为保持山东半岛海陆生态系统的完整性,推进海洋生态文明的建设,需要从现行的法律体系中寻求相关的法律依据,并分析其不足和缺陷,提出改进的建议。此外相关制度的完善对推动山东半岛蓝色经济区走生态文明发展之路至关重要,着重对海洋生态补偿机制、海洋资源有偿使用制度以及海洋功能区划制度作了论证,从而为半岛蓝色经济区的健康发展提供制度支撑。
This paper discusses a series of ecological environmental hidden trouble associated with the construction of Shandong Peninsula Blue Economic Zone, such as marine pollution, destruction of marine ecosystems, deple- tion of marine resources and other problems caused by the structuring of modern marine industry and other marine projects as well as coastal tourism. In order to maintain the integrity of land and ocean ecosystem in Shandong Pen insula and promote the construction of the marine ecological civilization,we need to seek the legal basis from the existing legal system,analyze its shortcomings and put forward the improving suggestions. In addition,it＇s very important to perfect the related system for the Shandong Peninsula Blue Economic Zone. This paper focuses on the argument of the marine eco-compensation mechanism, the system of paid use of marine resources and the system of compartmentalizing marine function zone. It is expected to provide institutional support for the healthy development of the Peninsula Blue Economic Zone.
