摘要
尽管我们已经对应该加快文化立法、提高文化建设法制化水平达成了共识,但就文化立法的基本原则、文化立法的内涵外延及文化法的体系构成等诸问题仍然存在多元化的认识。通过对文化事业立法和文化产业立法各自研究进路和研究实践的考察,我们可以发现,当前的文化立法研究在结构上呈现不平衡态势,法制视角和法学方法尚未得到普遍关注和运用,迄今也未勾勒出文化法制的完整的顶层设计方案。
Although we have reached a consensus that cultural legislation should be accelerated to improve the institution- alization of cultural construction, there are still arguments over the basic principles of cultural legislation, the connotation and extension of cultural legislation, the composition of cuhural law and so on. By the inspection of the respective research approa- ches and research practice of cultural institution legislation and cultural industry legislation, we can find that the current re- search on cultural legislation becomes unbalanced in structure, the legality perspective and jurisprudence method are not com- mon in the research on cultural legislation, and the whole top-level design of cultural institution has not been outlined so far.
