摘要
最高人民法院的司法决策会受到政治正确的考虑、利益集团的压力和公众舆论的态度等因素的影响。对于各种影响因素,应借助于程序的合法化功能,将它们纳入法律程序的轨道。
Judicial decision-making of the Supreme People＇s Court may be influenced by the consideration of political correctness, the pressure from interest group and the attitude of public opinion, etc. And various factors affecting the policy-making should be placed in the rail of legal proceedings with the aid of the legality of procedures.
