摘要
抵押物转让是指抵押人基于自己的意思表示而将抵押物的所有权让与给第三人的行为,是抵押人在法律上对抵押物进行处分。抵押物转让制度应在抵押权人、抵押人与第三人之间谋求利益平衡,既保证债的安全又充分发挥物的经济作用。从立法上看,大陆法系各国和地区所规定的抵押物转让制度,大多是在确认抵押权的追及效力的基础上设计相关配套制度。我国抵押物转让制度经历了《担保法》、《担保法》司法解释及《物权法》的历史沿革。《物权法》第191条在抵押物转让的限制与自由方面做了有益的尝试,但仍有必要做进一步的探索和完善,比如应将动产抵押物排除在该条的适用范围之外,同时应确认抵押权的追及效力。
Mortgage transfer is an act of disposition that mortgagor transfers mortgage" ownership to the third party according to his/her own will. Mortgage transfer system shall try to make balance among mort gagee, mortgagor and the third party and between the safety of debt and economic utility of property. In the continental law system countries, the legal model of mortgage transfer is based on trace effect and com bined with other systems. In China, the system has experienced historical evolution of Guarantee Law, its judicial interpretation and Real Law. Article 191 of Real Law gives a good try to mortgage transfer sys tem, which needs further exploration and perfection and shall not be applicable to movable mortgage, and the trace effect of mortgage shall be set down in real law.
